Condominium Collections: The Court Process
Legal expenses incurred by the Condominium Corporation are usually the responsibility of Unit owners, and we seek to have those amounts paid by the owners. There are some court-approved guidelines as to what those amounts can be. In some instances, the court, the lender, or the owner, may object to the legal fees, if the matter became more complex. In those (hopefully rare) cases the Corporation is obligated to pay the legal fees.
Condominium Bylaws Revisions
Over the last number of years, the government enacted a significant number of changes to the Condominium Property Act and the Condominium Property Regulation. COVID-19 gave us many opportunities to interact with bylaws, and the government also tried to make some changes to assist and modernize meetings. Developments in case law have also occurred. Many Corporation bylaws could use a "refreshing."
Condominium Corporations and Privacy Obligations
All condominium corporations are subject to the Alberta Personal Information Protection Act ("PIPA"). PIPA may also apply to board members when they act on behalf of the condominium corporation. The legal obligations under PIPA also extend to any management company retained to fulfill any functions on behalf of the condominium corporation.

Suspension of Limitation Periods in Alberta during COVID-19
The Government of Alberta has issued temporary amendments to various legislation during the COVID-19 public health state of emergency. On April 9, 2020, the Minister of Service Alberta issued this Ministerial Order which temporarily affects the Condominium Property Act and regulation ("Act"), the Residential Tenancies Act and various other statutes, for 60 days, or as otherwise directed.
